Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Safe With Us at safewith.us (the “Service”), operated by Dharani Holdings Inc. (“we,” “us”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement.

3. The Service

Safe With Us lets you create encrypted links to messages and files that can be opened a limited number of times before they are permanently deleted, and request information or files from others through encrypted links. We decide which kinds of files can be sent and how large they can be, and we may change these at any time. The Service is currently free. We may change, add, or remove features, or suspend or discontinue the Service, at any time.

4. Your responsibilities

• Protect your links. Anyone with a full link, and its passcode if one is set, can open it. If you lock a link to an email, they also need the code we send to that address. Share links only with people you intend to, and only enter an email address that belongs to the person you’re sending to.
• Save what you need. We cannot read, recover, or restore messages, links, tracking links, or inbox links. If you lose one, it’s gone.
• You’re responsible for what you send and for having the right to share it.
• Verify who you’re dealing with. We can’t confirm the identity of senders or requesters. Only answer requests from people you know and trust.

5. Acceptable use

You agree not to use the Service to:

• Break any law, or help anyone else break the law
• Send phishing, scams, fraud, or attempts to trick people into revealing passwords or financial information
• Distribute malware, links to malicious software, or files disguised as something they’re not
• Harass, threaten, stalk, intimidate, or exploit anyone
• Share any content that sexually exploits or endangers children, or attempt to contact or groom minors
• Share content that infringes someone else’s intellectual property or privacy rights
• Send spam or automate the creation of links in bulk
• Interfere with, overload, or attempt to break the Service or its security, or get around rate limits or other protections
• Impersonate any person or organization

Good-faith security research is welcome if it avoids harm to users and data, and you report what you find to hello@safewith.us before disclosing it publicly.

6. Enforcement

Because messages and files are encrypted, we can’t see what you send. If we receive a report or have reason to believe the Service is being misused, we may disable links, block access, and take other steps to protect people and the Service. We may also cooperate with law enforcement as required by law, though we can only provide the limited information described in our Privacy Policy. To report misuse, use “Report this link” or email hello@safewith.us.

7. Not a storage service

Messages and files are deleted automatically when they are opened, destroyed, locked, or expire. Do not use the Service as your only copy of anything important.

8. Your content

You keep all rights to what you send. You give us only the limited permission needed to store and transmit your encrypted content to deliver the Service. We can’t read it, and we don’t use it for anything else.

9. Our rights

The Service, including its name, design, and code, belongs to Dharani Holdings Inc. These Terms don’t give you any rights to our trademarks or branding.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee that the Service will be uninterrupted, error-free, or completely secure, or that any message will be delivered or opened.

11. Limitation of liability

To the fullest extent permitted by law, Dharani Holdings Inc. and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed fifty U.S. dollars (US$50). Some places don’t allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to defend and hold harmless Dharani Holdings Inc. from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.

13. Ending your use

You can stop using the Service at any time. We may suspend or end your access if you violate these Terms or if needed to protect users or the Service.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Texas, and you agree to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. We’ll change the effective date at the top, and continuing to use the Service after an update means you accept the new Terms.
